Welcome to DMV Ads (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our advertising services, including but not limited to mobile billboard advertising, digital signage, parking lot ads, inflatable screen ads, and other out-of-home (“OOH”) advertising solutions (collectively, the “Services”). By purchasing, reserving, or using our Services, you agree to the following:
1. Services Provided
- DMV Ads provides out-of-home advertising solutions through:
- 495 Ads (mobile and digital billboards along the DMV Beltway).
- Parking Lot Ads (advertising signage and displays in private and commercial parking areas).
- Inflatable Ads (inflatable movie screens and event-based advertising installations).
- Services may include creative design, placement, installation, setup, and monitoring of advertisements.
- Availability of locations, placements, and displays is subject to change without notice.
2. Client Responsibilities
- The client is responsible for providing all advertising content (logos, copy, images, videos) in the required format and within specified deadlines.
- All content is subject to approval by DMV Ads. We reserve the right to reject any advertisement deemed inappropriate, unlawful, misleading, or non-compliant with applicable laws, regulations, or community standards.
- The client warrants that they own or have the legal right to use all creative materials provided.
3. Content Restrictions
The following content is strictly prohibited:
- False, misleading, or deceptive advertising.
- Obscene, pornographic, or sexually explicit material.
- Hate speech, discriminatory, or defamatory content.
- Content that infringes intellectual property rights.
- Content promoting illegal activity, controlled substances, or unlicensed products.
4. Scheduling & Placement
- Campaign schedules, placement locations, and durations will be outlined in the client’s advertising agreement.
- While DMV Ads makes reasonable efforts to honor placement and timing requests, exact positioning and display frequency cannot be guaranteed.
- Equipment may be temporarily unavailable due to weather conditions, technical issues, or local restrictions.
5. Payment Terms
- Payment terms will be outlined in the client’s invoice or contract. Unless otherwise agreed, payment is due in full prior to campaign launch.
- Late payments may result in suspension or removal of advertisements without refund.
- Deposits, when required, are non-refundable.
6. Cancellations & Refunds
- Cancellations must be submitted in writing.
- If cancellation occurs less than [X days] before campaign launch, the client forfeits all payments made.
- Refunds, if applicable, will be determined at DMV Ads’ sole discretion.
7. Liability & Indemnification
- DMV Ads is not liable for indirect, incidental, or consequential damages arising from advertising campaigns, including but not limited to loss of business, revenue, or reputation.
- DMV Ads is not responsible for interruptions caused by weather, mechanical failure, municipal restrictions, strikes, or other conditions beyond our control.
- The client agrees to indemnify and hold harmless DMV Ads, its employees, and affiliates from any claims, damages, or expenses arising from content provided by the client or from third-party disputes related to the client’s advertising.
8. Intellectual Property
- All artwork, designs, layouts, and concepts created by DMV Ads remain the property of DMV Ads unless otherwise agreed in writing.
- The client grants DMV Ads a limited license to use the client’s logo and brand materials for the purpose of fulfilling the campaign.
9. Compliance with Laws
- All advertisements must comply with applicable federal, state, and local laws, including but not limited to regulations on outdoor advertising, mobile billboards, permits, and public safety requirements.
- The client acknowledges that campaigns may be subject to municipal permitting or zoning restrictions.
10. Termination
- DMV Ads reserves the right to terminate any campaign immediately if the client violates these Terms, fails to make payment, or provides content that violates applicable laws or community standards.
11. Governing Law
- These Terms shall be governed by and construed in accordance with the laws of the State of [Insert State], without regard to its conflict of law provisions.
12. Amendments
- DMV Ads may update these Terms at any time. The updated version will be posted on our website with the date of the last revision.
